Limitation of Liability for Typographical Errors Policy THE Avokado WEB SITE AND THE MATERIALS HEREIN ARE PROVIDED "AS IS." Avokado EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO THE SITE, SITE UP-TIME OR SITE USE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. In the event a product is listed at an incorrect price due to typographical error or the product is no longer available, Avokado will have the right to refuse or cancel, without liability, any orders placed for product that is no longer available or is listed at the incorrect price. Avokado will have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Avokado will immediately issue a credit to your credit card account in the amount of the incorrect price.
Goods & Services Tax (GST) Policy Avokado is required to charge the applicable 12.5% GST for orders to be delivered to addresses within New Zealand. All prices throughout the site are GST inclusive. Total amount of GST is also separated out on your order form for your convenience. Each customer will be solely responsible for all sales taxes, or other taxes, on orders shipped to any other country.
Jurisdiction & Venue Policy The Avokado site is administered in New Zealand and all orders are deemed to be solely performed in New Zealand, regardless of where you are located. You agree that any legal action brought against Avokado will be governed by the laws of New Zealand without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the Avokado site will be an appropriate court located in New Zealand.Any cause of action must be brought within one (1) year from the date that the cause of action arose.

Payment Method Policy We accept Visa and MasterCard. All payments are required in NZ Dollars ($). Please be sure to provide your exact billing address and telephone number, which is the address and phone number your credit card bank has on file for you. Your credit card will be billed upon shipment of your order.
Inventory Policy Your receipt of an electronic or other form of order confirmation does not signify that the item(s) ordered were in stock at the time the order was placed. Avokado reserves the right to offer for sale items that are temporarily out of stock but are currently in production, and are expected to be placed into inventory within 7 business days from receipt of your order. If at any time after receipt of your order, Avokado discovers that there will be a longer delay, Avokado will notify you via email as to the "backorder" and you will be given the opportunity to cancel your order at this time. Avokado reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item in the form of a split shipment.
